These Terms and Conditions ("Terms") govern your access to and use of the GymNex gym management software and related services (the "Service"), operated by Innovexa ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.
1. The Service
GymNex is a subscription-based gym management software that lets gym owners and their staff manage members, collect and record payments, track expenses, send receipts and messages, manage branches and staff, and view business analytics. The Service is provided on mobile, tablet and web.
2. Eligibility & Accounts
You must be at least 18 years old and capable of entering into a binding contract to use the Service. You are responsible for keeping your login credentials secure and for all activity under your account. You agree to provide accurate information and to keep it up to date.
3. Subscriptions & Payments
Certain features require a paid subscription. Subscription prices and durations (Monthly, Quarterly, Yearly or custom) are shown within the app before purchase. Payments are processed securely through our payment partner, Razorpay. We do not store your card or banking details on our servers.
Your subscription activates once payment is successfully verified. By purchasing, you authorise us (via Razorpay) to charge the applicable amount.
4. Refunds & Cancellation
Payments are non-refundable once a subscription has been activated. You may cancel at any time; access continues until the end of your paid period. Full details are in our Refund & Cancellation Policy.
5. Acceptable Use
You agree not to misuse the Service, including: attempting to gain unauthorised access, reverse-engineering the software, uploading unlawful content, or using the Service to store data you are not legally permitted to process. You are solely responsible for the member and business data you enter.
6. Your Data & Ownership
You retain ownership of the data you enter (such as member records). You grant us a limited licence to process this data only to provide the Service. Our handling of personal data is described in our Privacy Policy.
7. Intellectual Property
The GymNex name, logo, software and design are owned by us and are protected by applicable laws. These Terms do not transfer any ownership of our intellectual property to you.
8. Service Availability
We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may update, modify or discontinue features from time to time.
9. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential damages, or for any loss of data, revenue or profits arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the three months preceding the claim.
10. Termination
We may suspend or terminate your access if you breach these Terms. You may stop using the Service at any time.
11. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the courts of Pune,Maharashtra.
12. Changes to these Terms
We may update these Terms from time to time. The latest version will always be available on this page with an updated date.
